A standard property transfer typically takes eight to twelve weeks from the date the offer to purchase is signed, depending on the complexity of the transaction and the efficiency of the various parties involved. This includes obtaining compliance certificates (electrical, plumbing, gas, beetle, and electric fence where applicable), issuing rates clearance figures from the municipality, obtaining transfer duty receipts from SARS, and lodging documents at the Deeds Office. We keep all parties informed throughout the process to ensure a smooth transfer.
Transfer fees (conveyancing fees) are paid by the purchaser to the transferring attorney for attending to the transfer of ownership from the seller to the buyer. Bond registration fees are paid by the purchaser to the bond attorney for registering the mortgage bond in favour of the bank. Both fee scales are set by the Law Society of South Africa and are based on the value of the property or bond amount. Our conveyancing calculator can provide you with an estimate of these costs.
Sectional title ownership, governed by the Sectional Titles Act 95 of 1986 and the Sectional Titles Schemes Management Act 8 of 2011, is a form of property ownership in which you own a specific section (unit) within a building, together with an undivided share in the common property. This is common in apartment complexes, townhouse developments, and mixed-use buildings. Owners are automatically members of the body corporate and must pay monthly levies to fund the maintenance and management of the scheme.
Transfer duty is a tax payable to SARS on the acquisition of property in South Africa. As of the current rates, properties valued at R1 100 000 or less are exempt from transfer duty, with a sliding scale applying to properties above this threshold. Transfer duty must be paid before the transfer can be registered at the Deeds Office. Note that if you purchase property from a VAT vendor (such as a developer), no transfer duty is payable as the purchase price includes VAT. Our attorneys will calculate the exact amount payable in your specific transaction.
Yes, our conveyancing team handles property transfers that form part of deceased estates. These transfers require additional steps, including obtaining Letters of Executorship from the Master of the High Court, advertising for creditors, obtaining a section 42(2) endorsement or liquidation and distribution account, and filing the necessary documentation at the Deeds Office. We work closely with the executor and estate agents to ensure that estate property transfers are completed efficiently and in compliance with the Administration of Estates Act.
