Litigation FAQs

The Magistrate’s Court handles civil claims up to R400 000 (or R200 000 in district courts) and is generally quicker and less costly. The High Court has unlimited jurisdiction in civil matters and deals with claims exceeding the Magistrate’s Court threshold, as well as matters involving constitutional issues, company law disputes, and applications for interdicts. Our attorneys appear in both courts and will advise you on the appropriate forum for your matter.

The duration depends on the complexity of the case, the court’s roll, and whether the matter is defended. Undefended matters (such as default judgments) can be resolved within six to eight weeks. Defended matters in the Magistrate’s Court typically take six to eighteen months, while High Court litigation can take one to three years or longer. Alternative dispute resolution methods like mediation or arbitration are often faster and can resolve disputes in a matter of weeks or months.

Mediation is a voluntary, facilitated negotiation process where a neutral mediator assists the parties in reaching a mutually acceptable settlement. The mediator does not make a binding decision. Arbitration, on the other hand, is a more formal process where an independent arbitrator hears evidence and arguments from both parties and makes a binding decision (an arbitral award). Both processes are private and typically faster than court proceedings. Our attorneys can represent you in either process.

Litigation costs include attorney fees (on either an attorney-and-client or party-and-party scale), counsel fees (if an advocate is briefed), court fees, Sheriff’s fees for service of documents, and expert witness fees where applicable. In South Africa, the general rule is that the unsuccessful party pays the successful party’s costs, though the court retains discretion. We provide transparent cost estimates at the outset and keep you informed of costs throughout the process.

Yes, in urgent matters the court may grant an interim interdict to prevent a party from performing a particular act (or to compel them to do something) pending the final resolution of the dispute. To obtain an urgent interdict, you must demonstrate a prima facie right, a well-grounded apprehension of irreparable harm, that the balance of convenience favours granting the interdict, and that you have no other satisfactory remedy. Our litigation team has extensive experience in urgent court applications.
